AtusPay Terms and Conditions

Welcome to AtusPay, a financial technology platform owned and operated by Atus West Africa Ltd(“AtusPay,” “we,” “our,” or “us”).


AtusPay provides digital wallet services, money transfers, bill payments, and related financial tools through our website and mobile applications (“Services”).


Our payment infrastructure is powered by Flutterwave, a licensed payment processor regulated by the Central Bank of Nigeria (CBN), ensuring all financial operations on AtusPay are secure, compliant, and seamless.


By accessing or using AtusPay, you agree to these Terms and Conditions. Please read them carefully before proceeding.



1. Acceptance of Terms


By registering or using AtusPay, you:

•Confirm that you are at least 18 years of age,

•Have read, understood, and accepted these Terms, and

•Agree to be bound by all applicable laws and regulations.


If you do not agree with these Terms, you must discontinue using the platform immediately.



2. Our Partnership with Flutterwave


AtusPay operates in partnership with Flutterwave, which provides the secure payment processing layer for all transactions performed through our platform.


Through this partnership:

•Flutterwave handles payment gateway, transaction routing, and settlements.

•Your payment details (e.g., card or bank information) are processed directly by Flutterwave, not stored on AtusPay’s servers.

•Flutterwave’s systems are certified under PCI-DSS Level 1, ensuring full financial data protection and compliance with the Central Bank of Nigeria and global standards.

3. Account Registration


To use AtusPay, you must create an account by providing:

•Your full name, phone number, and email address

•Valid identification (e.g., BVN, NIN, or government ID)

•Any other information required for Know Your Customer (KYC) verification


You agree to provide accurate, current, and complete information.

AtusPay reserves the right to suspend or terminate your account if false or misleading details are provided.



4. User Responsibilities

As a registered user, you agree to:

•Keep your login credentials confidential;

•Use the platform only for lawful purposes;

•Avoid impersonating any person or entity;

•Refrain from attempting unauthorized access, modification, or data extraction; and

•Take responsibility for all activities carried out through your account.


Any misuse of the platform may result in account suspension or permanent termination.



5. Payments and Transactions

All payments and transfers initiated on AtusPay are processed through Flutterwave’s secure infrastructure.


You agree that:

•Transaction fees (where applicable) will be displayed before confirmation.

•Completed transactions are final and non-reversible, except in cases of verified error or fraud.

•Delays or failures caused by your bank or mobile network are beyond AtusPay’s control.



6. Fees and Charges

AtusPay may charge service fees for certain transactions (e.g., transfers, withdrawals, or bill payments).

All fees will be transparently displayed before completion of any transaction.


We reserve the right to adjust fees as necessary, in line with business or regulatory changes.



7. KYC, AML, and Compliance

AtusPay complies with CBNNFIU, and NDPA regulations on:

Know Your Customer (KYC)

Anti-Money Laundering (AML)

Counter-Terrorism Financing (CTF)


We may request additional documents or verification at any time.

Failure to comply may result in account restrictions or suspension.



8. Data Protection and Privacy

Your privacy is important to us.

AtusPay collects and processes user information in accordance with our Privacy Policy and under the Nigeria Data Protection Act (NDPA).


In line with our partnership:

•Flutterwave may receive necessary user and transaction data for payment processing, fraud monitoring, and regulatory compliance.

•Both AtusPay and Flutterwave maintain industry-standard data encryption and storage practices.



9. Security

We employ end-to-end encryption, firewalls, and two-factor authentication (2FA) to protect user data and funds.


While we maintain strict security protocols, you are responsible for safeguarding your credentials and device.

AtusPay will not be liable for losses resulting from unauthorized access due to user negligence.



10. Service Availability

We aim to provide continuous access to our platform, but AtusPay does not guarantee uninterrupted operation.

Service interruptions may occur due to maintenance, upgrades, or third-party outages (including Flutterwave or partner banks).



11. Limitation of Liability

To the fullest extent permitted by law:

•AtusPay and Flutterwave shall not be liable for indirect, incidental, or consequential damages resulting from service use or failure.

•We are not responsible for losses caused by network errors, bank delays, or inaccurate user input.

•Our total liability shall not exceed the total fees paid by you for the affected transaction.



12. Intellectual Property

All content, trademarks, software, and branding related to AtusPay remain the property of Atus West Africa Ltd.

Unauthorized copying, modification, or distribution is strictly prohibited.



13. Account Suspension or Termination

AtusPay reserves the right to suspend, restrict, or terminate any account found to be:

•Engaged in fraudulent or illegal activity,

•In violation of these Terms, or

•Under investigation by relevant authorities.



14. Third-Party Links

AtusPay may include links to third-party platforms (including Flutterwave).

We are not responsible for the content or practices of such external sites.

Your use of third-party services is governed by their respective terms and privacy policies.



15. Changes to These Terms

We may update these Terms periodically.

When changes are made, the “Last Updated” date will be revised and, where required, users will be notified through the app or email.


Your continued use of AtusPay after such updates signifies your acceptance of the new Terms.



16. Governing Law

These Terms shall be governed by and construed under the laws of the Federal Republic of Nigeria.

Any dispute shall be subject to the jurisdiction of Nigerian courts.
